Measure L asks Dixon voters whether the position of City Treasurer should be appointed by the City Council rather than elected every four years. If Dixon voters approve Measure L, the City Council will appoint the City Treasurer when the City certifies the November 8, 2016 election results. The purpose of Measure L is to save City funds by eliminating the need to place the City Treasurer on the ballot. California law requires that general law cities, like Dixon, have a City Treasurer. City Treasurers may be appointed or elected. The Dixon City Council can only appoint a City Treasurer if voters first approve the change. Under current law, the requirements to run for City Treasurer are that an individual be at least 18 years of age and be a registered voter of the City. If Measure L passes, the City Council may set education and training requirements, review the City Treasurer’s performance annually, and remove the requirement that the City Treasurer be a Dixon resident. While the City Treasurer is generally responsible for receiving and depositing City funds, these duties are handled by the City’s Finance Department. The Dixon City Treasurer is an elected position and serves a four year term. In recent years, the City Council has appointed a City Treasurer due to a lack of candidates. If the City Treasurer becomes an appointed position, the City will save money on future election costs. A "yes" vote on Measure L will convert the office of Dixon City Treasurer into an appointed position. If a majority of Dixon voters approve Measure L, the City Council will appoint the next City Treasurer beginning in 2016 when the term of the current City Treasurer ends. A "no" vote on Measure L will leave the City Treasurer as an elected office. If Measure L fails, the candidate receiving the most votes in the November 2016 election will be elected as the City Treasurer.

 RESOLUTION CALLING FOR A BALLOT MEASURE CHANGING THE OFFICE OF THE CITY TREASURER FROM AN ELECTED POSITION TO AN APPOINTED POSITION; REQUESTING THAT THE BOARD OF SUPERVISORS OF SOLANO COUNTY CONSOLIDATE THE MUNICIPAL ELECTION ON THE MEASURE WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON NOVEMBER 8, 2016; FORMING A SUBCOMMITTEE TO DRAFT ARGUMENTS IN FAVOR OF THE MEASURE; AND AUTHORIZING THE CITY ATTORNEY TO DRAFT AN IMPARTIAL ANALYSIS OF THE MEASURE

 

WHEREAS, the City of Dixon’s (“City”) City Treasurer is currently an elected position; and

WHEREAS, the Dixon City Council (“Council”) desires that the position of City Treasurer be changed from an elected position to an appointive position; and

WHEREAS, pursuant to Government Code Section 36508, the Council may submit to the voters whether the position of the City Treasurer should be appointed by the City Council; and

WHEREAS, if the majority of the votes cast on the measure support converting the position to an appointive position, the Council shall appoint such officer upon the expiration of the term of the current City Treasurer in November 2016, or upon a vacancy in the office of City Treasurer; and

WHEREAS, a statewide general election is scheduled for November 8, 2016; and

WHEREAS, the City of Dixon passed Resolution 16-025 on February 23, 2016, submitting a measure to the voters to determine whether the position of City Treasurer should be appointive (the “Measure”) for the General Election to be held on November 8, 2016; and

WHEREAS, the Council has determined that it is in the best interest of the City and its citizens that its voters be asked to make the position of City Treasurer appointive and if that Measure does not pass, to allow the voters to elect a City Treasurer in order to ensure that this position is filled; and

WHEREAS, this Resolution supersedes Resolution 16-025 in its entirety.

 

 

           

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dixon finds, and declares as follows:

1.             The foregoing recitals are true and correct and are hereby incorporated by reference.

 

2.             Pursuant to California Government Code Section 36508, the Council hereby calls an election to be held during the statewide general election on Tuesday, November 8, 2016, and orders that the following question be submitted to the voters at such election:

 

Shall the office of the City Treasurer for the City of Dixon be appointive, with the first appointment occurring upon the expiration of the term of the current City Treasurer in 2016?

3.             This Measure is submitted pursuant to Government Code Section 36508 and Elections Code Section 9222.

 

4.             Pursuant to Elections Code sections 10002 and 10403, the Council hereby requests the Board of Supervisors of the County of Solano consolidate the election of this measure with the statewide general election to be conducted on November 8, 2016.

 

5.             The Council hereby requests that the Solano County Board of Supervisors permit the Solano County Registrar of Voters to provide any and all service necessary for conducting the election and agrees to pay for said services.

 

6.             The City Clerk is hereby directed to deliver forthwith certified copies of this Resolution to the Clerk of the Board of Supervisors of Solano County and the Registrar of Voters of Solano on or before August 12, 2016.

 

7.             The City Attorney is hereby directed to prepare an impartial analysis of the Measure pursuant to Election Code Section 9280, to be submitted to the City Elections Official on or before August 16, 2016.

 

8.             The City Council is hereby authorized and directed to form a two (2) member subcommittee with exclusive authority to formulate, execute and submit the argument in favor of the Measure limited to 300 words and to include up to five signatures, pursuant to Elections Code Sections 9282 and 9283, to be submitted to the City elections official on or before August 16, 2016.

 

9.             The two (2) member subcommittee shall be authorized to formulate, execute and submit a rebuttal to any argument submitted against the Measure, limited to 250 words, and to include up to five signatures pursuant to Elections Code Sections 9285 and 9283, to be submitted to the City elections official on or before August 26, 2016.

 

10.          The City Clerk and other City officers and employees are hereby authorized and directed to take all other actions that are necessary to have the City’s ballot measure properly submitted to the City voters at the statewide general election on November 8, 2016.
