City Attorney’s Impartial Analysis of Charter Amendment – Measure “N”

This Charter Amendment (“Measure”) would amend City Charter Section 602 to change the start time for the regular City Council meeting from 7:30 p.m. to 6:00 p.m. on the first Tuesday in December of each even-numbered year.

Section 602 of the City Charter currently provides that the City Council shall meet in regular session at 7:30 p.m. on the first Tuesday of each month. Section 602 allows the City Council to designate by ordinance a different time and date for City Council meetings, subject to the requirement that the council meet at least once per month, and that the council hold a regular meeting at 7:30 p.m. of the first Tuesday in December of each even-numbered year (the first City Council meeting following an election). As permitted by Section 602, by ordinance the City Council has set the start time for regular City Council meetings at 6:00 p.m. and holds meetings on the first and third Tuesday of each month, except that the first Tuesday meeting in December of each even-numbered year is held at 7:30 p.m.

This Measure will amend Section 602 to change the start time of the first Tuesday meeting in December of each even-numbered year to 6:00 p.m.

The effect of changing the start time of the City Council meeting held on the first Tuesday in December of each even-numbered year will be to have the start time for this meeting at 6:00 p.m., consistent with the start time of the rest of the City Council meetings. This Measure was placed on the ballot by the City Council.

A “Yes” vote means the voter approves the proposed changes that this Measure would make.

A “No” vote means the voter does not approve this Measure and no changes will be made to the City’s Charter. This Measure will become effective if a majority of those voting on this Measure vote “Yes.”
