City Attorney Impartial Analysis

The 941 Camino Del Mar Specific Plan (“Specific Plan”) will replace, in its entirety, the existing “Garden Del Mar Specific Plan” which was adopted in 2008. The Specific Plan will create a new “941SP” zone to replace the current “GDMSP” zone. The Specific Plan is intended to provide a regulatory framework for the redevelopment of the former gas station site with a mix of uses, site and building design, as well as, amenities that complement the village character of Del Mar.

The Specific Plan area consists of two adjacent parcels of land totaling 25,524 square feet located at the southwest corner of Camino Del Mar and 10th Street, in the City of Del Mar. The City Council introduced Ordinance 939, approving the 941 Camino Del Mar Specific Plan and voted to subject the Specific Plan to a voter referendum pursuant to Election Code § 9222.

Specific features of the Specific Plan include:

  • Establishment of mixed use zones which provide for a variety of land uses, including commercial (retail, restaurant, professional offices) and residential hospitality uses.

  • Development regulations and guidelines that will allow structures no more than two-stories in height, mandate retail or restaurant spaces be located at the Camino Del Mar street frontage and the inclusion of second floor residential units.

  • Design criteria (landscaping, architectural style and materials usage) which, when implemented will result in development that is similar and complementary in form, materials and overall scale to surrounding structures in the Del Mar Village.

  • Exceptional public benefits which may include affordable housing and financial contributions to public improvements.


Any future development proposed pursuant to the Specific Plan is subject to Design Review in accordance with the requirements of DMMC Chapter 23.08.

If a majority of the voters vote “Yes” on Measure T, future development within the Specific Plan area will be subject to the development standards and regulations of the Specific Plan. If a majority of the voters vote “No” on Measure T, the existing zones would remain and future development would occur under the former Garden Del Mar Specific Plan.

ARGUMENT IN FAVOR OF MEASURE T – 

APPROVAL OF HE 941 CAMINO DEL MAR SPECIFIC PLAN

 

The 941 Camino Del Mar Specific Plan is a regulatory and policy document that provides vision, standards and design guidelines for the development of the vacant, former gas station property at 941 Camino Del Mar. The Plan would not approve a particular building design, rather implements the vision of the City’s Community (General) Plan by facilitating mixed-use development of the property in a manner that is complementary to existing structures in the Del Mar Village, while providing new opportunities for retail, restaurants and housing on a lot that has been vacant for more than 15 years.

 

The 941 Camino Del Mar Specific Plan would provide flexibility to allow future development to respond to changes in the economy, with development standards and guidelines that ensure any building design would adhere to a “village” scale, and utilized materials, lighting and landscaping that minimize impacts to surrounding properties. Moreover, the Plan mandates that any project undergo the same public outreach as any other development proposal in the City (including placement of story-poles), and be subject to review and approval by the Design Review Board. 

 

The 941 Camino Del Mar Specific Plan presents a rare opportunity to facilitate the redevelopment of a blighted and long-vacant property that could serve as a potential gateway to the heart of the Del Mar Village. The Plan provides development flexibility, strong protections for community character and public participation, and would further the Community’s Plan’s vision for a mix of uses in the Village. We urge you to support Measure T to approve the 941 Camino Del Mar Specific Plan.
