Measure BB is submitted to the voters by the Pasadena City Council and would amend the Pasadena City Charter to provide for the election of the members of the Board of Education of the Pasadena Unified School District (“PUSD”) in even-numbered years to align with Statewide General Election dates, and extend their current terms of office by 19 months on a one-time basis.

Background

On January 25, 2018, the PUSD Board of Education (“Board”) supported an amendment to the Pasadena City Charter to change the timing of future Board elections to occur on Statewide General Election dates in even-numbered years, consistent with a California Attorney General Opinion that the California Voter Participation Rights Act (“CVPRA,”) requires this change. The Board proposed changing the format of Board elections to plurality voting, with successful candidates required to receive the most votes for each Board race at the Statewide General election. To transition to statewide dates, the terms of office for current Board Members would be extended on a one-time basis by 19 months. On February 15, 2018, the City Council of the City of Pasadena, on behalf of the PUSD Board, approved proposed language to amend the City Charter, and authorized the submittal of said amendment to the voters of PUSD and called the necessary special election.

The Measure

If passed, Measure BB would change the timing of the start of terms of office for Board Members to even years, beginning in 2020 and 2022, and respectively every four years thereafter, and terms would start at the Board’s organizational meeting held the fifth Monday following the Statewide General election. To account for the impact of this change on sitting Board Members, the Measure would establish a one-time 19-month extension of terms for the current Members. The Measure changes the timing of the Board President’s Annual Address to occur no later than May of each year.

By aligning Board elections with statewide elections, it is anticipated the Measure would increase voter turnout, reduce PUSD’s anticipated increases to election expenses, and ensure the integrity of the election process, by shifting responsibilities for elections to the Los Angeles County Registrar of Voters.

If Measure BB does not pass, Board Members will continue to be elected in odd-numbered years per the current Charter, and expenses for administering elections will increase. Continuing elections in odd-numbered years could be asserted in court to violate the CVPRA for not providing opportunity for increased voter participation, and could result in potential legal liability on the part of PUSD for damages, fees and costs.

Measure BB requires approval of a majority of voters. A “yes” vote for Measure BB will change the City Charter to be consistent with state law and would align Board elections to occur on Statewide General Election dates in even-numbered years. It would result in a one-time extension of the current terms of office by 19 months. A “no” vote against Measure BB will maintain Board elections in odd-numbered years and would not extend the current terms of office.

Argument FOR Measure BB – City Charter Amendment to Change the Timing and Format of Pasadena Unified School District Election

In order to comply with the California Voter Participation Rights Act (CVPRA), passed in 2015, Pasadena’s Charter must be modified to move the School Board election dates for Pasadena Unified School District.

The school district includes Pasadena, Altadena, and Sierra Madre. As the CVPRA includes punitive measures for local governance areas that do not comply with the law, if this ballot measure does not pass, the school district will likely face an expensive legal challenge.

The current Primary/Runoff format of School Board elections will be replaced by a single plurality election which will take place during the state general election in November. Winning candidates for the offices of School Board will be selected on the highest vote total of all candidates for that office.

To transition from our current, odd-numbered year elections, to statewide even-year election dates, the terms of office for the current School Board members are proposed to be extended. This will happen on a one-time basis, moving the end of current terms 19 months to December 2020 and December 2022, respectively. Elections then will follow every four years thereafter.
